Vehicular homicide is typically a misdemeanor the first degree and carries a sentence of up to 180 days in jail and a $1000 fine.

If, however, the offender was under suspension or did not have a valid drivers license or had a prior offense in one of several categories, Vehicular Homicide is a felony of the fourth degree.

In that case, Vehicular Homicide carries a sentence of up to 18 months in the penitentiary.

In addition, the court will impose a class four license suspension, at a minimum, to anyone convicted of Vehicular Homicide.

Certain aggravating factors can cause the court to impose either a class three or a class two license suspension on the offender.
